Terms and Conditions of use of BUFF® social media.

1. Purpose of the presence of BUFF® on social media

The purpose of our presence in the social media is to create meeting points with Internet end users so that their comments and suggestions may help us to improve the quality and communication of our products. In this regard, we encourage and thank the Internet end users for their participation and we will undertake to answer all the comments or suggestions received, whenever they comply with these terms and conditions.

The acceptance of these terms and conditions is an essential requisite for accessing and participating in the forums of BUFF® in the social media. By accessing, publishing posts in our forums, or accepting that we use in our social media any material posted or published anywhere else, the end - user is required to comply with or agree with these terms and conditions.

“Social media” includes all internet websites or mobile-based websites, internet applications and services that allow end-user interaction.

“BUFF® social media” include all the parent company (ORIGINAL BUFF, SA) and worldwide subsidiaries’ social media.

ORIGINAL BUFF, SA shall include the parent company and all its worldwide subsidiaries, collectively referred to as “BUFF”, “we”, or “us.

2. Contributions or posts or User Generated Content.

2.1 All type of comments, consultations or suggestions contributed by our followers or end-users as submissions, posts, photographs, essays, comments, or tweets, blogs, videos, consumer reviews, ..., posted or published on BUFF® social media (hereinafter referred to as contribution or post or User Generated Content) must comply with the following rules:

  • Must not contain any material that promotes bigotry, racism, hatred, or harm against any group or individual on the basis of race, sex, gender, political beliefs, religion, nationality, sexual orientation or age.
  • Must not contain any material that disparages any persons or organizations.
  • Must not contain any material that includes threats to any person, place, business, or group. • Must not contain any material that is unlawful in violation of any applicable federal, provincial, territorial, municipal, or local laws or regulations
  • Must be respectful with the opinions published by other users.
  • Must not disseminate comments that signify discrimination towards or disqualification of other users for any reason.
  • Must be related to BUFF®. Must not contain any material that contains or displays any commercial/corporate advertising other than that of BUFF®, including, but not limited to, corporate logos, brand names, trademarks, slogans, political or religious statements.
  • Must not disseminate publicity for commercial or political purposes, either directly or through links to other pages of Facebook or websites in general.
  • The same message with the same content or links to the same places cannot be repeated more than once.
  • Must not contain any material that violates or infringes another person’s copyright, trademark or any other intellectual property rights or privacy, personality or any other rights.
  • Must not contain any material that contains indecent, violent, or unsafe behaviour or situations, profanities, or obscenities, including but not limited to nudity or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, defamatory, slanderous or libelous.
  • Must not contain any material that refers, depicts or in any way reflects negatively upon ORIGINAL BUFF, its affiliates, its brand.

2.2 By participating in the BUFF® social media, or accepting that we use in our social media any material posted or published anywhere else, the end - user agree to all of the following:

2.2.1 We may determine, in our sole discretion, whether or not to accept any type of contribution or posts posted to the BUFF® social media or elsewhere.

2.2.2 In the event that any contribution or post contravenes these terms and conditions, we reserve the right to unilaterally proceed to their elimination without prior notice, to impede their issuers from participating in the channels of BUFF® and, furthermore, to make it known to the Legal Department of the pertinent social media, of the law enforcement authorities or of the competent courts, as may be applicable in each case.

2.2.3 You hereby confirm that you own the content and information you posted and/or shared via BUFF® social media or that you authorized us to use in our social media, as well as any content or information sent to BUFF® by any other means; this applies whether these content and information contain or do not contain BUFF® #, whether they are your name, likes, comments, texts, photographs, videos and any other medium.

2.2.4 You grant us and our affiliates, official distributors, its successors, assigns, and designees (collectively referred to as “BUFF ”, “we”, or “us”) permission to use your User Generated Content as follows: a license to reproduce, download, copy, alter, modify, adapt, translate, delete, display, perform, distribute, transfer, broadcast, sell, resell, license, and otherwise use all or part of your User Generated Content in connection with the Site and for other BUFF® global digital marketing purposes including, without limitation, in BUFF® websites, social media, email and other customer communications, and other media whether now known or developed in the future.

2.2.5 You agree that we may display advertisements in connection with your User Generated Content or on pages where your User Generated Content may be viewed by you or others, and we may use your User Generated Content to advertise and promote BUFF® products, services or the Site.

2.2.6 You grant us a license on your User Generated Content that is non-exclusive, meaning you may use the User Generated Content for your own purposes or let others use your User Generated Content for their purposes. You also grant us a license on your User Generated Content that is fully-paid and royalty free, meaning we do not owe you anything else in connection with our use of your User Generated Content. We may exercise these rights on your User Generated Content anywhere in the world. Finally, our license is irrevocable and perpetual meaning that the license you grant us to your User Content cannot be revoked and lasts for an indefinite period of time.


2.2.7 You promise, warrant and represent that:

  • You own all rights pertaining to your User Generated Content or, alternatively, that you have the right to grant BUFF® rights described above;
  • You have permission to use the name and likeness of any other person shown in the User Content;
  • You have paid and will pay in full any fees or other payments that may be related to the use of your User Content; and
  • Your User Generated Content does not infringe the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party.

2.2.8 You will indemnify, defend and hold us, our subsidiaries and affiliates and official distributors, our directors, officers, employees, shareholders, parent, affiliates, and agents against any losses, liabilities, claims expenses (including attorney's fees) arising out of your breach of any representation or warranty as stated above, any third party claim regarding the use by us of your User Generated Content, or any action taken by you that is inconsistent with the rights granted as described above.

2.2.9 We may refuse to accept or transmit User Generated Content for any reason. We may remove User Generated Content from the Site or social media for any reason. We are under no circumstances required to use or obligated to use your User Generated Content.

3. Exemption of liability

The comments of the users are free, personal and not attributable to BUFF® or us for which reason we are not liable, either directly or indirectly, for their content or their accuracy and updating of the information that may be provided on other natural or legal persons that may participate in our social media.

Furthermore, we are not liable for the use by third parties of the information contained in their virtual social spaces.

4. Privacy

We undertake to preserve the privacy of the data and the information that the users provide in order to formalize their registration in our virtual spaces or to receive services that we provide in them. You can check our privacy policy.
