1.- ORGANISER
The company ORIGINAL BUFF, S.A. (hereinafter, “BUFF” or the “Organiser”), with address at Calle de Francia, 16, 08700 Igualada (Barcelona, Spain) and Corporate Tax Code (CIF) A58034000, is holding a promotional draw (hereinafter, the “Draw”), under its responsibility and in accordance with the terms and conditions set forth below, to calculate the carbon footprint of the travel undertaken by the people attending the Val d’Aran by UTMB® event.

2.- START AND CLOSING DATES

Entries for the Draw will be accepted from 6 July 2022 at 08:00 h (CEST+2: Spain) until 15 September 2022 at 18:00 h (CEST +2 Spain).

The winner will be drawn on 20 September 2022.

3.- ELIGIBILITY
Participants must meet the following requirements:

1. The Draw is open to natural persons of full legal age, regardless of the location of their main place of residence, who fill in the online carbon footprint form and sign up to the newsletter about BUFF® products and/or services.

2. The Draw is not open to the following persons: (i) ORIGINAL BUFF, S.A. employees or persons working for ORIGINAL BUFF, S.A. through a temporary employment agency; (i) any other natural persons who have been directly or indirectly involved in the organisation, preparation or running of the Draw (such as agencies and suppliers).

3.No BUFF® products need to be purchased in order to take part in the Draw.

BY ENTERING THIS DRAW, PARTICIPANTS AGREE TO THESE TERMS AND CONDITIONS AND TO BE BOUND BY THEM. Participants who do not meet all the requirements of the terms and conditions of this Draw may be disqualified by the Organiser at its sole discretion.

4.- METHOD FOR TAKING PART IN THE DRAW

Participants may enter the Draw in accordance with the following mechanism:

1. An iPad will be available at the BUFF® stand in the Val d’Aran by UTMB® event for participants to access and fill in the online carbon footprint form.
2. Participants must answer the questions on the carbon footprint form and provide the personal data required in it (email address), read and accept the terms and conditions of the Draw and the privacy policy, click on the option to receive commercial newsletters about BUFF® products and/or services, and click on the “Submit answer” button they will find on the form. Once they have registered, participants may cancel their newsletter subscription at any time without losing their entry in the Draw.
3. Participants will receive an email confirming their entry in the Draw and their newsletter subscription.

Their participation will be confirmed when the entry information is recorded in the Organiser’s server. All entries must be fully completed and shall be subject to verification by the Organiser at its sole discretion. Proof of submission (such as screenshots) shall not constitute proof of participation or receipt of an entry.

One Entry per Person: Any actual or suspected attempts to use robotic, automated, programmed or unlawful means to take part in the Draw, or any other methods not permitted by these Terms and Conditions, such as, for example without limitation, the use of multiple identities or entries, shall be viewed as tampering and will result in the participant’s disqualification.

Entries containing false or incomplete information will be void. Late, illegible or damaged entries, entries sent to the wrong place or that are unclear or altered or irregular in any other way or in breach of any or all of these terms and conditions will be void. The Organiser reserves the right to disqualify at any time any entries containing obscene, offensive, pornographic or sexually explicit or defamatory, derogatory or infringing material or other inappropriate content or subject, as decided at its sole discretion by the Organiser.

No correspondence will be entered into except with the winner of the Draw. Disqualified participants will not be notified of their disqualification.

5.- TERMS OF THE DRAW AND PRIZES

The Draw will take place on 20 September 2022.

A single (1) winner will be chosen randomly using the www.easypromosapp.com

platform. This is a platform that ensures that the result of the Draw is transparent and issues a validation certificate. The result cannot be altered by the Organiser of the Draw, and the certificate can be requested from the Organiser any participant.

There will be a total of 1 (one) prize, which will consist of: (i) a voucher/pass for a 6-day “BUFF® entre Refugios” TREKKING tour (https://buffentrerefugios.com); and (ii) a goody bag of BUFF® products.

The “BUFF® ENTRE Refugios” voucher/pass is worth €320 (three hundred and twenty euros) and includes 6 days of trekking, 5 nights’ accommodation, 5 days’ half board, online tracking, a Buff® Original product, a Salewa t-shirt, a waterproof bag, a first-aid kit, a box of Yogi Tea, an official guide and map, and en-route assistance. https://buffentrerefugios.com/tarifas-servicios-trekking/ .T he voucher/pass will be sent to the winner by e-mail and will be valid until 31 December 2023.

The Buff® product goody bag is valued at €104.95 (one hundred and four euros and ninety-five cents) and contains the following BUFF® products: 2 Original products, 1 Pack Speed Cap, 1 Pack Baseball Cap, and 1 CoolNet UV® Wide Headband. The goody bag will be sent to the winner by courier.

The prize is not transferable or subject to change, alteration or compensation at participants’ request, and neither may it be exchanged for money or a different product.

The Organiser reserves the right to provide a different prize if the prize described in these terms and conditions cannot be provided for reasons beyond its control. In such case, the Organiser undertakes to ensure that the new prize is the same or similar in nature and/or financial value as the original prize. The prize will not be exchanged for its cash value in any event.

The holding of the Draw and the award of prizes are subject to the tax legislation currently in force.

The promoter accepts no liability for any human or other errors that may occur when processing entries or for any error, omission, interruption, deletion, fault, delay in operation or transmission,

theft or destruction, unauthorised access or alteration, of registrations, or for any technical, network, telephone, computer, hardware or software issues or the faulty transmission of any registration information or the inability to receive it due to technical traffic congestion issues on the Internet or any website.

6.- DELIVERY OF THE PRIZE TO THE WINNER

The Organiser will contact the winner by email within no more than 15 (fifteen) business days from the date of the Draw.

The chosen winner may be required to prove that they are the person who entered the Draw (for example, by showing their ID card or similar document).

If the winner fails to reply to the e-mail informing them of the win, or to expressly accept the prize, within 5 (five) business days after such notification, or if the prize cannot be awarded because they do not meet the requirements of the terms and conditions or for any other reason, the prize will be declared void

7.- LIMITATIONS

ORIGINAL BUFF, S.A. reserves the right, if there are justified reasons and after giving prior notice in the manner envisaged by law, to suspend or extend this Draw or make any changes to it at any time and in any way.

Without prejudice to the foregoing, the Organiser reserves the right to cancel the Draw if it cannot be held as originally planned for any reason, including an event of force majeure.

Any fiscal or tax levies that may arise as a result of accepting the prize, as well as any other expenses arising from the promotion that are not expressly accepted by the Organiser under these Terms and Conditions, shall be paid by the winner in advance.

8.- DISQUALIFICATIONS AND PENALTIES

If it becomes clear that any participant does not fulfil the requirements and the terms and conditions set forth herein, or if the details provided in order to take part in the Draw are not valid, the entry will be deemed to be void and the participant will be automatically excluded from the promotion and lose any rights to the prizes awarded under this Draw.

No correspondence will be entered into except with the winner. Disqualified participants will not be notified of this fact.

9.- EXEMPTION FROM LIABILITY

We will accept no liability, for example without limitation, for any possible loss, theft, delay or any other circumstance attributable to third parties that may affect the running of this Draw. We will similarly accept no liability for any damage resulting from the prize, from any use that may be made of it by a participant, or for any loss or damage of any kind that may be suffered by any participants, the winner or any third parties.

We will accept no liability in cases of force majeure or act of God preventing the Draw from taking place or hindering the full or partial enjoyment of the prize. We reserve the right to cancel, modify or suspend the Draw if it cannot take place due to technical errors or the detection of fraud or for any other reason beyond the Organiser’s control that affects the normal running of the Draw.

10.- DATA PROTECTION

The personal information provided by participants and/or the winner in connection with this Draw shall be collected, stored and processed by or on behalf of the Organiser, acting as data controller, strictly in compliance with EU Regulation 2016/679 (the General Data Protection Regulation – GDPR) and Spanish Organic Law 3/2018 of 5 December 2018 on Personal Data Protection and the Guarantee of Digital Rights (LOPDGDD).

The purpose of the processing will be the management of participants’ participation in the Draw, checking that the requirements for taking part in the Draw and winning the prize have been fulfilled, contacting the winner and delivering the prize, and sending commercial communications only to those participants who have signed up to receive them.

Participants not wishing to receive commercial communications may cancel their subscription by clicking on the Unsubscribe button appearing at the end of the emails sent by the Organiser or by sending a request to the Organiser’s postal address and contact email addresses provided in this clause.

The Organiser will share participants’ personal data with the third parties hired by it to help manage the Draw, who will act as data processors. In particular, it will share such data with EASYPROMOS, S.L., the owner of Easypromos, the platform that will be used to choose the winner. EASYPROMOS, S.L. is a company incorporated under the laws of Spain with Corporate Taxpayer’s Code (CIF) B-65576878 and address at Calle Bonastruc de Porta 20, Girona (Spain), registered in Volume 2966, Folio 59, Sheet No. GI-56021 of Girona Commercial Register.

11.- CHANGES AND ACCEPTANCE

The Organiser reserves the right to amend or extend these terms and conditions of the promotion to the extent that participants’ rights are not undermined or detrimentally affected by such amendment or extension.

BY ENTERING THE DRAW, PARTICIPANTS FULLY AGREE TO THESE TERMS AND CONDITIONS WITHOUT ANY RESERVATIONS OR QUALIFICATIONS.

12.- JURISDICTION AND APPLICABLE LAW

This promotion and these terms and conditions are subject to Spanish law.

Any claims or disputes that may arise in relation to the validity, construction or performance of these Terms and Conditions shall be settled by the Spanish courts with jurisdiction.
